Indian Army occupies 305 acres in Gulmarg against 130 ‘allotted’
SRINAGAR; 15, May 2013: Indian Army occupies more than 305 acres of land in Gulmarg against the “allotted” 130 acres in the ecologically fragile tourist resort, according to the state government.
In its compliance report to the directions by the High Court in a Public Interest Litigation, Divisional Commissioner Shalindara Kumar said that he chaired a meeting of the committee constituted by the government to find out details about the possession of land with the Army and leases granted to people from time to time with their status, on April 29 last.
“With regard to the land in possession of the Indian Army, ex-CEO Gulmarg Development Authority (who was present in the meeting as special invitee) informed that the measurements of the said land has been made by Settlement Officer, Kashmir through ETS (Electronic Total Station) during 2005,” Kumar said. “The print out of the demarcated land was called from the Settlement Officer. It has been informed that Indian Army is in possession of 305 acres, 5 Kanals and 13 marlas as compared to 130 acres of land allotted to them.”
The meeting, Kumar said, asked the Settlement Officer Kashmir to submit the demarcation report regarding the land occupied by the Army within three days.
Subsequently, on May 2, the Settlement Officer submitted a report to the Divisional Commissioner Kashmir prepared by him after visiting the spot (High Altitude Warfare School) along with a team of experts with survey instruments.
“It was found that (HAWS) and other affiliated military formations are holding 2445 kanals and 13 marlas of land as per the map which is inconformity with the possession on spot,” the Settlement Officer said.
With regard to the leases, the ex-CEO informed the meeting chaired by the Divisional Commissioner that a total of 84 cases have been granted lease hold rights from time to time. “Out of which lease period has expired in 26 cases.”
The Divisional Commissioner was also informed in the meeting that no application has been received for renewal of the leases.
The meeting was attended by Deputy Commissioner Baramulla, Director Tourism Kashmir, ex-CEO GDA, Executive Engineer on behalf of CEO GDA and Tehsildar Tangmarg
Subsequently, the Divisional Commissioner directed CEO GDA to prepare a detailed report of all lease cases and the CEO submitted the details to him. The Divisional Commissioner has also asked Deputy Commissioner Baramulla and CEO GDA to furnish details regarding applications received under the Roshni Act.
Among those whose lease has expired include former Chief Justice Shadi Lal (four kanals), and Janki Nath, Muzaffar Hussain Beigh and Mohammad Yasin Mir (15 kanals and 18 marlas).
