Kunan-Poshpora Mass Rape: High Court Refuses to take Petition

SRINAGAR; 14, May 2013: The Jammu and Kashmir High Court today refused to take up a petition on the Kunan-Poshpora mass rape case, holding that it would be premature for it to intervene as the case is pending before a Sessions court.

A division bench comprising Chief Justice M M Kumar and Justice Ali Mohammad Magray refused to entertain the petition filed by human rights activist Parvaiz Imroz on behalf of 50 alleged victims of the mass rape by Indian troopers that took place in 1990.

The petitioner has appealed for re-investigation into the case and compensation for the victims.

The bench observed that it would be premature for it to intervene in the case as the same was pending disposal before the Sessions Court in Kupwara. The court, however, asked the Sessions Court to expedite the proceedings.

The State Human Rights Commission had in 2011 directed the state government to pay compensation of Rs two lakh each to the victims. However, so far, no compensation has been paid.

According to records, on Febuary 19, 1991, when units of the Indian army launched a search and interrogation operation in the village of Kunan Poshpora, located in Kupwara District. At least 53 women were allegedly gang raped by Indian troopers that night. However, Human Rights organizations including Human Rights Watch have reported that the number of raped women could be as high as 100. More than 22 years have passed and yet justice was not delivered with the victims.
