2 Innocents Acquitted after 9 Years
JAMMU; 20, Sep 2013: Principal Sessions Judge Jammu has acquitted Ghulam Ahmed Mir S/o Abdul Aziz and Riaz Ahmad Khan S/o Mohd Hafiz Khan both residents of Thanamandi alleged rebels of Hizbul Mujahdeen as prosecution miserably failed.
According to the police case that September 2, 2004, they were found traveling in a Tata sumo bearing registration No. JK11- 2313 which was intercepted by the Indian Army at Manial Gali Rajouri and Ghulam Ahmed Mir, Raiz Ahmad Khan, Mst. Hazra Begum and two children, one boy and one girl aged 8 to 10 years, were found traveling in the vehicle. The said vehicle was brought to Manial gali under escort, where it was checked by the security forces and on its checking Rs. 57,240/, one telephone diary, visiting card, five money order receipts, were recovered from the accused Ghulam Ahmad Mir and letter pad head of Hijbul Mujaheedin, driving licence, one love letter written by Saima Khan and passport application receipt of Riaz Ahmed Khan were recovered from the accused Riaz Ahmad.. This recovery was suggestive of objectionable activities adopted by the accused Ghulam Ahmed Mir in order to transfer funds to terrorist from one place to another. On the written report of the complainant, i.e. Major Adjutant 13 Rashtriya Rifles Regiment, FIR No. 129/2004 for the commission of offence falling under section 3/E.A.O was registered against the accused and investigation ensued. During investigation, the police seized the recovered currency notes as well as other articles and apprehended the accused on the spot. After investigation, the final report was submitted in this court.
Principal Sessions Judge Jammu Mr. Kartar Singh after hearing Adv Rupak Ratta appearing for the accused persons observed that the conclusion is irresistible that there is not even an iota of incriminating evidence against the accused. They are, therefore, acquitted of the charge framed against them.
